1. Who you are contracting with
BandOps ("BandOps", "we", "us") is operated by Timothy Richard O'Neill, a sole trader (trading as "BandOps"). References to "the service" mean the BandOps web application at bandboss.live and related features.
2. Acceptance
By creating an account or continuing to use the service you agree to these terms. If you don't agree, don't use the service.
You confirm you are of legal age in your country and, if you're using BandOps on behalf of a band or organisation, that you have authority to bind it.
3. What BandOps does
BandOps is a management tool for small bands: song library, setlist builder, gigs, files, public EPKs, release planning and related workspace features. Availability of specific features depends on your plan.
4. Your account
You are responsible for keeping your login credentials confidential and for activity that happens under your account. Provide accurate information and keep it up to date.
5. Acceptable use
You must not misuse the service. In particular, you must not:
- use the service for anything unlawful, fraudulent, or abusive;
- send spam or unsolicited outreach through the platform;
- infringe anyone else's intellectual property or privacy;
- upload malware, probe, scan, or otherwise interfere with the security of the service;
- scrape, reverse engineer, or attempt to circumvent technical limits;
- resell, sublicense, or redistribute the service without written permission.
6. AI features
BandOps includes AI-assisted features (setlist suggestions, poster and release-plan generation, content assistance, advisor chat). You are responsible for your prompts, for verifying outputs before you rely on them, and for making sure you have the rights to any content you feed in. AI output can be inaccurate or incomplete and is not professional advice.
You must not use the AI features to generate illegal content, deepfakes, hate speech, malware, or content that infringes third-party rights. We may filter, refuse, or remove AI outputs, and suspend accounts for repeated or serious misuse.
7. Your content
You keep ownership of the songs, files, images, contacts, and other content you upload. You grant us a limited, non-exclusive licence to host, process, and display that content solely so we can provide the service to you and your band.
If a rights-holder tells us content on BandOps infringes their rights, we may remove it. Repeat infringers will have their access terminated.
8. Our intellectual property
The BandOps software, design, and branding remain our property. We grant you a limited, non-exclusive, non-transferable right to use the service under your active plan.
9. Payments, subscriptions, and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms: paddle.com/legal/checkout-buyer-terms.
Paid plans renew automatically at the interval shown at checkout until cancelled. You can cancel any time from Settings → Billing; access continues until the end of the current billing period.
10. Service level
We work hard to keep BandOps running well, but we don't guarantee that the service will be uninterrupted, error-free, or that AI outputs will meet any particular standard. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is capped at the fees you paid us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill.
Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that can't be limited under applicable law.
12. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay, present a security or fraud risk, or repeatedly violate our acceptable-use rules. You can close your account any time. On termination we will delete your workspace data within a reasonable period, subject to backups and legal retention obligations.
13. Changes
We may update these terms as BandOps evolves. Material changes will be highlighted in-app or by email. Continued use after changes means you accept the updated terms.
14. Governing law
These terms are governed by the laws of England & Wales, and disputes are subject to the exclusive jurisdiction of the courts of England & Wales, unless mandatory local consumer law says otherwise.
